1. Nature of Service

Dastawez is a private facilitation platform. We are NOT a government authority, CSC (Common Service Centre), or MP Online authorized service provider.

Our services include:

• Document preparation, printing & scanning
• Online application and government form filling assistance
• Resume / CV creation
• Affidavits and legal documentation assistance
• Support in accessing government portals (MP Online, etc.)
• Doorstep document delivery

2. Governing Laws

These Terms & Conditions are governed by the applicable laws of India, including but not limited to:

• Information Technology Act, 2000
• Indian Contract Act, 1872
• Indian Penal Code, 1860 (as applicable)
• Digital Personal Data Protection Act, 2023
• Consumer Protection Act, 2019

By using our services, you enter into a legally binding digital contract with Dastawez under the above laws.

3. User Authorization & Digital Consent

By using our services, the user explicitly:

• Provides informed and voluntary consent to Dastawez to access, process, and upload their documents on relevant portals on their behalf
• Authorizes Dastawez to act strictly as a facilitator only, not as a legal authority
• Acknowledges that clicking "I Agree" or using the service constitutes a legally binding digital agreement, equivalent to a physical signature under the IT Act, 2000
• Agrees that all submissions made via Dastawez are considered self-submitted by the user

4. No Official Affiliation Disclaimer

Dastawez explicitly declares that:

• We have no official tie-up, recognition, or affiliation with any government body, ministry, CSC, or MP Online
• All services are performed using publicly available government platforms and user-provided credentials / information
• Final authority on document approval, rejection, or processing lies solely with the respective government authority

5. User Responsibility & Legal Liability (Critical Clause)

The user is fully responsible for the accuracy and legality of all documents and information submitted to Dastawez.

The user MUST:

• Provide true, accurate, complete, and legally valid information
• Ensure all documents submitted are authentic and not forged
• Verify all details before submission and approval

If the user provides:

• False or incorrect information
• Forged or fabricated documents
• Misleading or incomplete data

Under applicable provisions of the Indian Penal Code and the IT Act, submission of false documents may attract serious legal penalties against the user.

6. Fraud & Misrepresentation Disclaimer

If any document is created, processed, or submitted based on incorrect, fraudulent, or misleading information provided by the user — whether intentionally or unintentionally:

• Dastawez shall NOT be held responsible or liable
• Full legal responsibility rests entirely with the user who provided the data
• Dastawez acts solely as a data processor and facilitator, not as a verifier or legal authority

Dastawez reserves the right to report any detected fraudulent activity to the appropriate authorities as required by law.

7. Indemnity Clause (Legal Shield)

The user agrees to fully indemnify and hold harmless Dastawez, its owner, team members, partners, and associates from and against any and all:

• Legal claims, suits, or proceedings
• Losses, damages, or financial penalties
• Government actions or notices

Arising directly or indirectly from:

• Incorrect or false data provided by the user
• Misuse of Dastawez services
• Any fraudulent activity by the user

8. Data Privacy & Consent

By using Dastawez services, the user agrees to our Privacy Policy (which must be read separately before proceeding).

Dastawez ensures:

• Data is used solely for service completion purposes
• Reasonable security measures are maintained to protect user data
• User documents are not shared with any third party except as required to complete the service (e.g., uploading to government portals)

However, Dastawez is:

• Not liable for third-party platform data breaches or security failures
• Not responsible for any misuse of data that occurs after service delivery

Sensitive personal data should be shared at the user's own discretion and risk.

9. Third-Party Platform Disclaimer

Government portals, websites, and platforms (such as MP Online) are independently operated third-party services. Dastawez has no control over them.

Any delays, errors, technical failures, or rejections caused by these platforms are NOT the responsibility of Dastawez.

10. Payment & Refund Policy

• All payments must be made in advance or at the time of service initiation
• Service charges may vary depending on the type and complexity of the service
• Once a service is initiated or completed — NO REFUND will be provided
• A refund will only be considered if the service has not been started at all
• Refunds, if applicable, will be processed within a reasonable timeframe

11. No Guarantee Clause

Dastawez does not guarantee:

• Approval or success of any application or document
• Specific processing timelines by government authorities
• Any particular outcome from services rendered

Delays or rejections resulting from government system issues, policy changes, or technical errors are outside Dastawez's control and are not our responsibility.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Dastawez shall not be liable for:

• Any direct, indirect, incidental, or consequential damages
• Legal consequences arising from user-provided data or documents
• Any misuse of documents after service delivery
• Technical failures, server downtime, or delays beyond our control

13. Force Majeure

Dastawez shall not be responsible for delays or failure in service delivery due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters or acts of God
• Government restrictions, lockdowns, or policy changes
• Server outages or third-party platform failures
• Technical failures beyond Dastawez's control

14. Record Keeping & Evidence

Dastawez may store the following for internal records and legal protection:

• Transaction logs and service records
• Chat and communication records
• Document submission proofs

These records may be used as evidence in the event of legal disputes or regulatory inquiries.

15. Right to Refuse Service

Dastawez reserves the right to:

• Refuse service to any user at any time without prior notice
• Reject any request that appears suspicious, illegal, or in violation of these Terms
• Terminate service immediately upon detection of fraudulent or prohibited activity

16. Eligibility (Age Clause)

• Users must be 18 years of age or above to use Dastawez services independently
• Minors may only use the service under the direct supervision and authorization of a parent or legal guardian
• By using our services, you confirm that you meet the age eligibility criteria

17. Intellectual Property

• All documents, data, and content submitted by the user remain the property of the user
• Dastawez's proprietary templates, design formats, branding, and service systems are the intellectual property of Dastawez and may not be copied or reproduced without written permission

18. Prohibited Activities

Users must NOT:

• Submit fake, forged, or fabricated documents
• Use Dastawez services for any illegal purpose
• Attempt to defraud, misrepresent, or deceive Dastawez or any third party
• Engage in any activity that violates applicable Indian law

Violation of any of the above may result in:

• Immediate service termination without refund
• Reporting to law enforcement authorities if required

19. Cancellation Policy

• Orders that have been processed cannot be canceled
• Cancellation requests are only valid if the service has not yet been initiated
• Cancellation after service initiation will not be eligible for a refund

20. Jurisdiction Clause

All disputes arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Bhopal, Madhya Pradesh, India.

21. Modification of Terms

Dastawez reserves the right to update, modify, or revise these Terms & Conditions at any time without prior notice.

Continued use of Dastawez services after any modification constitutes your acceptance of the updated Terms.
